BestCar Corfu Car Rental Insurance Policies and Surcharges

Age and License Requirements

Rent over 22-60 years 50cc.

Rent over 25-60 years 125cc.

FDW insurance for new drivers 19-24 years old:

• FDW insurance for new drivers 19-22 Driver or Extra Driver for categories 50cc & insurance for new drivers 23-24 Driver or Extra Driver for categories 125cc
• If the driver or the extra driver you have to purchase this extra.
• Also, you have to purchase the GOLD Insurance (FDW)
• Our company policy is to rent Group 50 cc only to drivers from 19 years old, while being a holder of a driving license for 1 year.
• The insurance for this case is the FDW and excess 300€.
• Credit or debit card must be available, otherwise if you are paying in cash you must pay 300.00€ for guarantee.
• Prices for insurance may fluctuate by season but the final price is the one shown on the booking.

Insurance Coverage

Third party insurance (3rd.P.I.) for the vehicle is provided: with 3rd party insurance in case of an accident our insurance company covers the cost of the damage you have caused to another vehicle.

No insurance coverage applies:

• For whatever happened and found that the driver is under the influence of alcohol or drugs.
• For damage caused by driving on unpaved roads.
• For damages caused to the bottom of the motorcycle, the tires and rims.
• For accidents caused by a driver not declared in the lease contract.
• For accidents for which the lessee has not updated BestCar Corfu Car Rental company and submit an accident report, as defined by the Greek Legislation, regardless of fault.

The tenant is responsible for any damage or theft (partial or total) caused to the rented vehicle up to the amount of market value at the time of the accident / theft.

The lessee expressly agrees that the company BestCar Corfu Car Rental is not responsible for any incidental or consequential damage suffered by the tenant or third parties during the lease, and no claim may be brought against it for higher causes.

In any case of accident, the customer is obliged to contact the company immediately so that the insurance can be valid.

In any case of accident and for the warranty, the customer is charged with 25 euro administration fee + Local tax 24%.

Vehicle Usage

• The tenant is not allowed to use the vehicle for racing, wheelies or walks on the sand.
• The vehicle may be driven only by the driver and the persons referred to in this tenancy agreement.
• The tenant is not allowed to take the vehicle outside the island of Corfu.
• The tenant must return the vehicle to the lessor company in the same good condition you received it.
• In case of mechanical damage, the tenant must immediately notify the lessor company.

Additional Terms

• Traffic violations – Fines: All fines and administrative penalties shall be borne by the renter.
• Renter must lock the vehicle whenever it is left unattended.
• Fuel: The fuel costs are borne solely by the renter. The lessee is obliged to return the motorcycle to the content of the tank to be like when received.
• Any delay (to the due delivery time) of more than 2 hours is charged with one additional rental day.
• After signing this rental agreement no refund of money is possible.

Additional Rental Information

Additional rental information will be added to the contract upon delivery of the Scooter.

Rental Agreement

In Corfu today / / between the contracting parties on the one hand Mr. Spyridon Buhayar, owner of a car rental business under the company name 'Best Car Rental Corfu' with registered office in Corfu and VAT number 124382529 herein and for the sake of brevity referred to as the “lessor-entrepreneur” and on the other hand ................................... resident ................................... holder of the bank credit card number ...................... who herein and for the sake of brevity will be referred to as the “lessee – declarant”, the following terms and conditions are agreed, concluded and mutually accepted:

The lessor – entrepreneur-businessman leases or rents to the lessee – (renter) declarant the vehicle (car) referred to in the main contract of hire with the terms and conditions stated therein.

In view of the deceptive practices against the company and the consequent insulting to its reputation and clientele with the intention of extorting money for/to obtain an illegal pecuniary benefit, in cases where the firm has a claim for damages caused by lessees, with negative criticism and false representations on social media; or through the application of google reviews in breach of the policies criticism policies, the lessee declares the following:

• 1.- Any assessment of the company will be based on true facts that the lessee will disclose to the lessor without delay and without any intention of affecting the reputation and clientele of the business. If the business is affected by false criticism, the lessee shall acknowledges that such false criticism was made with the intent to deceive and for the purpose of/to obtain an illegal pecuniary benefit and the business retains the right to civil claims for any damage caused to the company (property, moral and lost profits) and a claim for criminal prosecution for fraud under Article 386 CC.
• 2.- Acknowledges that the use of a credit card according to the lease contract serves as a guarantee for the payment of any claim (debt or tort) from damage caused to the vehicle during the use of the vehicle in any way, whether on the move or parked or from a general breach of any term of the lease contract. Also and at the same time acknowledges that the cancellation of the amount of the transaction with the business in the context of restitution of all or part of the claim, constitutes fraudulent conduct subject to civil and criminal penalties given the right of the lessor to denounce any untrustworthy conduct to the Greek and international authorities (the Federal Office for the Prosecution of Electronic Crime, the Federal Trade Commission etc.).
• 3.- Has been informed and will comply or has complied faithfully with the terms of the Article 3 of Presidential Decree 10/2017 (A` 23), Consumer Code of Conduct and in particular:
  • (a) The lessee has carefully read and understand the terms of the lease contract and the terms concerning the management and protection of their personal data.
  • (b) The lessee shall be consistent and exercise due diligence in relation to financial or other obligations to the undertaking.
  • (c) The lessee should refrain from acts of defamation of the undertaking which are intended to the sole purpose of which is to damage their professional and commercial reputation
  • (d) For any query, complaint or request for assistance in respect of the vehicle or service provided, the lessee shall address him/herself directly to Mr. Spyridon Buhayar or an authorized employee of the company, to act within the statutory time limits, or in the absence of such time limits, within a reasonable time after receipt of the request.
  • (e) Provide the undertaking with their address and contact details, and any information necessary for the conclusion of the contract; and inform them of any subsequent changes, where necessary, in particular in the event of failure to repair damages to the vehicle.
  • (f) The lessee should /she shall not abuse his/her rights and shall ensure that the complaints, both to the undertaking and to the competent authorities, are adequately documented.
  • (g) The lessee should check, in cooperation with a competent official of the undertaking, all the necessary supporting documents of the undertaking the vehicle.
  • (h) Any conduct of the vehicle shall be guided by the principles of Good Faith, Trust and Transparency and Respect for Greek legislation.
  • (i) The lessee also declares that he has taken note of the fact that he has clearly and transparency, in English, of the terms of the contract, the total amount of the contract and the terms and conditions of the contract, including taxes, fees, costs, as applicable, as well as any kind of additional, in relation to the minimum content of the contract, terms and conditions under which provision is made for the payment of compensation for any damage to the undertaking or its vehicles, any charges due to premature termination of the contract, the conditions of service, the guarantees (content, duration and extent of territorial validity), for any actual defects of the hired vehicle, for any action in the event of an accident or damage.
  • (g) The potential out-of-court dispute settlement resolution of their possible future disputes and provide relevant information on recognized alternative dispute resolution bodies for consumer disputes, to which the undertaking will refer to / make use of.

To the credit of the foregoing, the present document has been drawn up in accordance with the Presidential Decree 10/2017, Article 12 of the Joint Ministerial Resolution 70330 of 30.6.2015 of the Ministers of Economy, Infrastructure, Shipping and Tourism, Justice, Transparency and Human Rights, on compliance with the provisions of Directive 2013/11/EU of the European Parliament and of the Council, of 21th May 2013 on alternative dispute resolution for consumer disputes (B`1421), Decision No 91354/24.8.2017 of the Minister of Economy and on the codification of the rules on trade and marketing Decision of EETT No. 131354/93 on the regulation of the trading of products and provision of services.

1032/6/30.5.2022, on the Code of Conduct for the Provision of Services Electronic Communications Services to Consumers (B` 3242) , Regulation (EU) 2022/1925 of the European Parliament and of the Council of 14th September 2022 on enforceable and fair markets in digital media and amending Directives (EU) 2019/1937 and (EU) 2020/1828 (Digital Marketplaces Act) (L 265), Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 Regulation (EU) No 2022/2022 of the European Parliament and of the Council of 19th October 2022 on the single market for digital services and the Directive 2000/31/EC (Digital Services Act) (L 277) & quot;, Under reference G1-699/23.6.2010 Joint Ministerial Decision of the Ministers of Finance, Economy, Competitiveness and Shipping, Justice, Transparency and Human Rights, on the adaptation to the Directive 2008/48/EC of the European Parliament and of the Council of 23rd April 2008 on the application of the Directive on credit rating systems (B` 917) and related provisions.

IN CASE OF AN ACCIDENT

In case of an accident the Lessee-Renter must immediately inform the police and at the same time Mr. Spyridon Buchayar, with full details, in order to apply for the agreed insurance.

In the event of any kind of accident (collision, diversion, simple scratch etc.), for the validity of the insurance to third parties, damage liability waiver (FDW), the accident’s report form must be presented to Mr. Spyridon Buchayar & on return the accident declaration must be completed and signed up. Otherwise, the Lessee-Renter will be liable for the total damage caused. Damage caused by negligence, violation of the Road Traffic Code or illegal parking is not covered by the insurance.

The deductible amount of the indemnity is charged in full and corresponds to the sum of 500€ for the small category A – B – C economy, 700€ for the category C- D – E1, and 1200€ for the category E2 – J7- J9. 700€ for the small category 50 cc - 125cc WITH DEPOSIT, 900€ for the category 200cc WITH DEPOSIT, 1100€ for the category 300cc WITH DEPOSIT. Each accident declaration is subject to a charge of EUR 25 plus V.A.T. for administration fees.

The interior of the car (cabin saloon, upholstery, dashboard, instruments, R/CD) as well as the rear-view mirrors, wheel covers, and the antenna of the car are not covered by any insurance unless they are caused by a collision. Upholstery with stains and tar on the interior of the car will be charged EUR 70.

BUSINESS DECLARATION

The company under the name "Best Car Rental Corfu" with its headquarters in Corfu island declares that:

«With absolute respect to the rights of the consumer, by signing the rental contract, the lessee will sign and the declaration of compliance with the consumer’s Code of Conduct”.

In particular, our company is in the difficult position of having to deal with phenomena of deception practices and insult to its reputation and clientele by certain vehicle lessees who have either concealed losses in vehicles or entered into a contactless banking transaction which they cancelled outright afterwards, with the intention of saving the amount of compensation for the damage of the vehicles they caused and to obtain illegal property benefit and extortionate practice. The aforementioned lessees made negative reviews with false representations in social media or through the google review application, persuading unknown persons to do the same, committing the offence of fraud.

The company declares that it reserves the right in the present and the forthcoming future to claim for compensation and restoration for any damage caused to its reputation and its customers.
